THIS IS AN AGREEMENT BETWEEN YOU OR THE ENTITY THAT YOU REPRESENT (hereinafter "You" or "Your") AND EXPERTS IN SOLUTIONS PRIVATE LIMITED (hereinafter "MySalon") GOVERNING YOUR USE OF MySalon ONLINE BUSINESS PRODUCTIVITY.
Parts of this Agreement
This Agreement consists of the following terms and conditions (hereinafter the "General Terms") and terms and conditions, if any, specific to use of individual Services (hereinafter the "Service Specific Terms"). The General Terms and Service Specific Terms are collectively referred to as the "Terms". In the event of a conflict between the General Terms and Service Specific Terms, the Service Specific Terms shall prevail.
Acceptance of the Terms
You must be of legal age to enter into a binding agreement in order to accept the Terms. If you do not agree to the General Terms, do not use any of our Services. If you agree to the General Terms and do not agree to any Service Specific Terms, do not use the corresponding Service. You can accept the Terms by checking a checkbox or clicking on a button indicating your acceptance of the terms or by actually using the Services.
Description of Service
We provide an array of services for Website, Client Subscription, Mobile App, email client, chat client, Appointments, customer relationship management application ("Service" or "Services"). You may use the Services for your personal and business use or for internal business purposes in the organization that you represent. You may connect to the Services using any Internet browser supported by the Services. You are responsible for obtaining Internet access and the equipment necessary to use the Services.
Subscription to Beta Service
We may offer certain Services as closed or open beta services ("Beta Service" or "Beta Services") for testing and evaluation. You agree that we have the sole authority to determine the duration of the Beta Services. We will be the sole judge of their success and the decision to launch them commercially. You are under no obligation to subscribe to any paid Service as a result of participating in a Beta Service. We reserve the right to discontinue any Beta Service at any time. You agree that MySalon will not be liable for any harm caused by modification or discontinuance of Beta Services.
Modification of Terms of Service
We may modify the Terms upon notice to you through a service announcement or email to your registered email address. If changes significantly affect your rights, you will receive at least 30 days notice. You may terminate your use of the Services by notifying MySalon within 30 days if the Terms are modified in a manner that affects your rights. Upon termination, you will receive a prorated refund of unused prepaid fees. Continued use of the Services signifies your acceptance of the modified Terms.
User Sign Up Obligations
You must sign up for a user account by providing required information. If you represent an organization, we recommend using your corporate email address. You agree to provide accurate, current, and complete information and update it regularly. If any provided information is inaccurate or incomplete, MySalon may terminate your account.
Organization Accounts and Administrators
When creating an organization account, you may specify administrators who can configure Services and manage users. If your organization account was created by a third party, they may act as administrator. Ensure you have an agreement with them regarding their responsibilities. You are responsible for safeguarding your organization account credentials and ensuring all account activity complies with this Agreement.
You may specify a process for recovering administrator access by emailing info@mysalon.in. In absence of such process, MySalon may grant access based on provided authorization proof. You agree not to hold MySalon liable for actions taken in good faith.
Personal Information and Privacy
Personal information you provide to MySalon is governed by the MySalon Privacy Policy. By using the Service, you accept the Privacy Policy terms. You are responsible for maintaining confidentiality of your username, password, and other sensitive information. Immediately notify us of any unauthorized access by emailing info@mysalon.in. We are not liable for losses arising from unauthorized access.
Communications from MySalon
The Service may include communications such as announcements, administrative messages and newsletters. These are part of your Service usage. You may opt-out of newsletters but not service-related messages.
Complaints
If MySalon receives a complaint regarding your activities, we will forward it to your registered email. You must respond to the complainant within 10 days and copy MySalon. Failure to respond permits MySalon to disclose your contact information to the complainant.
Fees and Payments
Services are available under various subscription plans. Plans shorter than a year must be paid via Credit Card. Renewals are automatic unless you downgrade or notify us otherwise at least 7 days prior. Subscription fees will be charged to your last used Credit Card. We may modify prices or charge for previously free Services, with changes applying only after the current billing cycle.
Restrictions on Use
You shall not: transfer Services to third parties; offer Services-based offerings without permission; use third-party links without agreeing to their terms; misuse trademarks; publish confidential data without consent; overload or harm MySalon servers; violate laws; or create false identities.
Spamming and Illegal Activities
You agree not to use Services for unlawful, abusive, defamatory, harmful, obscene, or infringing activities. You may not transmit spam, chain letters, or phishing emails. MySalon reserves the right to terminate access for illegal or unauthorized activities.
Inactive User Accounts Policy
MySalon may terminate unpaid accounts inactive for 90 days. Prior notice will be provided along with option to back up data. Activity in one service does not count for other services unless shared under one account.
Data Ownership
You own the content you create or store. MySalon will not use your content without permission except as required to provide Services. You grant MySalon rights to store, transmit, display or reformat your content solely for Service functionality.
User Generated Content
You are responsible for all content you publish. Public content may be indexed by search engines. You must ensure you have permission for any copyrighted material you upload. MySalon may remove content upon complaints. Contact info@mysalon.in for concerns.
Sample Files and Applications
MySalon may provide sample files for demonstration. Such files contain random data and are not guaranteed for accuracy or usefulness.
Trademark
MySalon, MySalon logo, the names of Services and logos are trademarks of EXPERTS IN SOLUTIONS PVT LTD. You may not use these without permission.
Disclaimer of Warranties
YOU AGREE THAT USE OF THE SERVICES IS AT YOUR OWN RISK. SERVICES ARE PROVIDED "AS IS". MySalon DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT GUARANTEE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE SERVICE.
Limitation of Liability
MySalon SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF BUSINESS, DATA, OR PROFITS. TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID FOR THE SERVICE.
Indemnification
You agree to indemnify and hold harmless MySalon and its affiliates from any claims arising from your violation of laws, rights of others, or these Terms.
Arbitration
All disputes shall be resolved via binding arbitration under Indian Council of Arbitration rules. Arbitration will occur in India. MySalon may seek injunctive relief from courts when needed.
Suspension and Termination
We may suspend or terminate your account for illegal activity, inactivity, or law enforcement requests. Objections may be emailed to info@mysalon.in. You may terminate your account at any time. Refunds apply only when MySalon breaches its obligations.
